Kacaw委員：秘書長好。昨天跟今天早上，外交及國防委員會在審查陸海空軍懲罰法，這裡面很重要的就是說，到底什麼樣的……因為在討論的過程當中一直希望，司法院針對軍人怎麼樣懲罰，它是一個懲戒還是懲罰。譬如說，軍官、士官、士兵在行政院版的陸海空軍懲罰法裡面，第十八條中譬如說「撤職」，士官也有「撤職」，這個都是職業軍人，然後士兵也有職業軍人，有「廢止起役」，然後也有「剝奪或減少退除給與」，這個軍官、士官都有，這是財產權的剝奪，甚至是工作權的撤職，所以一直在討論，這些比較重的，是不是可以剝奪他的工作權、是不是能夠在懲戒法院裡面……更涉及到司法院的權責，所以今天就是提出來請秘書長回去請相關的同仁再好好地研議，可以嗎？"],["吳秘書長三龍：可以。"],["鄭天財Sra Kacaw委員：好。因為現在我們的軍人真的是愈來愈少了，所以大家要保障他們的工作權，上次因為時間的關係，今年3月4號我在這邊有質詢過秘書長，當然這個案子更早之前我也質詢過前任的秘書長。就是我們有一個鄉親已經八十幾歲，他從小就跟著父母親在自己祖先留下來的土地耕作、種植，但是因為他沒有所有權，它是國有土地，所以就被判刑，被判刑時引用了「上列被告因違反山坡地保育利用條例」。事實上整個查了之後，雖然有法扶的律師，法扶基金會今天也有在場，當初也有請法扶的律師協助，可能畢竟法多如牛毛，不是盡然全部都瞭解，也不知道它不是山坡地範圍內，不瞭解水土保持法，或是山坡地保育區跟山坡地搞不清楚。事實上，山坡地保育區跟山坡地範圍內不一樣，山坡地保育利用條例是指山坡地範圍內，所以不一樣。後來這位老先生八十幾歲被判刑，一個禮拜之後就過世，他說這是他祖先用的土地，現在卻被判刑。後來查了之後才知道，原來它不是山坡地，所以引用了錯誤的法律，雖然他已經過世了，但還是要平反，畢竟他的子女一查，永遠是犯刑法、被判刑的人的子女。甚至他的子女要繼續使用，也就變成是違法的，因為被判刑了。這也會涉及到如果他的孩子是軍人，也有可能因為違反刑事法，萬一被告，又要被撤職。所以類似像這樣的問題都必須要去解決。","109年11月5日，本席也曾經在這邊質詢過。這個部分你們也很慎重，臺灣高等法院暨所屬法院法律座談會列了這個臨時提案，有甲說跟乙說，結果主持人說「本提案保留，不予討論」，這樣重大的事情！所以我才會在上次特別請秘書長回去要請同仁再重新討論，上次秘書長說再研議，這個部分如果還沒有結果的話，不要忘記，繼續趕快去處理，好不好？"],["吳秘書長三龍：請刑事廳……"],["鄭天財Sra
