Too事件促使了性平三法大翻修，很可惜其中關於延長兒少性侵追訴時效的修法，並未及時充分地被討論以及修正。因此，本席在本會期再次提出延長兒少性侵追訴時效的刑法修正草案，最重要就是要將追訴期從一開始起算到被害人成年之後，或是有意願、有能力可以參與偵查及審判程序時才開始起算，以充分保障被害人的權利。","首先，有鑑於兒童跟青少年在歷經性侵害後，往往不容易在短時間內揭發被性侵害的經歷，我們也看到非常多的案例，包括有國小學童可能在相關的求學過程當中，被他最親近的人性侵害，但等到他成年之後，始敢吐露他的心聲，而且往往是多人被害，有一個人開始吐露之後，才能夠開始揭發這樣的犯行。澳洲皇家調查委員會的全國機構進行兒童性侵調查時發現，倖存者平均要花23.9年，才敢第一次揭露童年被性侵的經歷。基於兒少性侵跟猥褻案件的特殊性，兒少遭遇性侵及猥褻的當下往往不知道自己正遭受到侵害，或是在當下不知道怎麼樣行使權利，亦或是迫於加害人巨大權力的不對等，當下難以求助，而日後或成年有可能已經超過了刑事追訴期，也因此我們當然要予以修正。","因此，本席特別提出修正刑法第八十三條第一項、第二項的規定，明定追訴權時效至成年前停止進行；明定當被害者已成年，或是當被害者雖然未成年，但是對於自身被害的事實有充分認識，有意願及能力能夠參與偵查及審判的程序時，追訴權才繼續進行。我想這是一個態度問題，也是我們中華民國要跟全國人民宣告的態度事項，任何的犯罪者，你不要意圖染指未成年人，尤其是用性侵害、暴力的手段去不當地對待。我想現在我們在一個網路世代，非常多的科技日新月異，也越來越多年輕的朋友、未成年朋友能夠大鳴大放，但是我們並不是老古板，我們在修正這樣的法令的時候，並不是以威權的方式去看待，而是當我們要給予最基本的保障，如果有任何的犯罪者利用自己的權勢、身分、地位，意圖對於未成年的，不管是少男、少女進行性侵害的話，我們一定予以嚴懲，這也是為什麼本席特別提出來刑法第八十三條的修正案。而且我們看到司法院也有整理出，無論是德國、美國、日本、奧地利、丹麥、義大利等相關的國家，都對於相關的犯罪有延長追訴權，或者是無期限的追訴權。也因此，我認為我們中華民國、我們臺灣應該與時俱進，請各位委員及行政部門能夠支持本席的修法──刑法第八十三條，我們一起努力，為青少年、為未成年兒童築起一道可以保護他們，最基本的保護牆，謝謝。"],["主席：好，謝謝洪委員。","接下來我們請王育敏委員進行提案說明。"]],"agenda":{"page_end":254,"meet_id":"委員會-11-1-36-26","speakers":["吳宗憲","洪孟楷","王育敏","沈發惠","陳俊宇","莊瑞雄","羅智強","林思銘","翁曉玲","黃國昌","鍾佳濱","吳思瑤","傅崐萁","楊瓊瓔"],"page_start":211,"meetingDate":["2024-05-27"],"gazette_id":"1135102","agenda_lcidc_ids":["1135102_00010"],"meet_name":"立法院第11屆第1會期司法及法制委員會第26次全體委員會議紀錄","content":"一、併案審查(一)委員洪孟楷等21人擬具「中華民國刑法第八十三條條文修正草案」案、(二)委\n員王育敏等21人擬具「中華民國刑法增訂第八十條之一條文草案」案；二、繼續併案審查
