謝謝黃婕委員的發言接下來請沈伯陽委員發言"}]}}},"gazette":{"lineno":175,"blocks":[["黃委員捷：（12時49分）在座各位同事，大家午安。今天原住民委員會組織法其實已經多次在委員會跟協調會都討論過了，但是一直都沒有達成共識，為什麼？就是因為這一次的修法實在是毫無邏輯，這個修法目的更讓人難以理解！在這次修法裡面，要求原住民的主委要由山地原住民跟平地原住民來輪流擔任。過去有多位的原住民委員，包括提案的委員在內，都曾經站在這個質詢臺上面說，山地跟平地原住民的區分是殖民者強加在原住民身上非常不合理的區分，而這樣的區分過去在所有的理論上也缺乏科學依據，更沒有民族學理論上面的支持。對於原住民而言，有意義的是族別、是部落，而不是山地跟平地的區分，這個標籤加上去，只是讓原住民族自我殖民、自我標籤，甚至是自我閹割。","這次的修法，大家都認為是在走回頭路，如果要讓原住民的主委由山地跟平地來輪流擔任，就是大大的退步，這種過時的劃分方式，應該要去打破，如同剛剛張宏陸委員提的，我們可以去打破、我們可以去廢除山地跟平地的區分，而不是在這裡走回頭路，把自己綁進這個框架，自我枷鎖，甚至是讓這個毫無邏輯的依據變成原住民主委的任命。如果真的要公平，那是不是我們讓16族的原住民族來輪流擔任呢？照這個邏輯，如果套用在其他部會身上，就可以看得出來，這一次的修法是多麼地沒有邏輯了。","最後，我還是要提醒一下，行政院長對於各部會的部會首長的人事決定權是非常重要的，這個是非常明確而且清楚的憲政原則，行政一體，如果行政院長想要落實自己的政策願景，就要能夠親自決定部會首長是誰，這個是憲法第五十六條明確賦予院長的權力，也是責任政治落實的必要條件。在行政一體的原則之下，行政院長可以自己選擇誰要來擔任部會首長，並給予充分的尊重，這個也是釋字第613號解釋不斷強調的重點。","所以請在座的所有立法委員記得，在憲法面前，立委沒有比較大，請立法委員遵守自己應盡的憲法忠誠義務，而不是去剝奪其他憲政機關賦予的權力。藍、白過去已經被憲法法庭判過違憲一次，現在難道還要不斷地去試探憲法的底線嗎？謝謝。"],["主席：謝謝黃捷委員的發言。","接下來請沈伯洋委員發言，吳琪銘委員請準備。"]],"agenda":{"page_end":92,"meet_id":"院會-11-2-11","speakers":["韓國瑜","江啟臣","羅廷瑋","陳菁徽","張智倫"],"page_start":43,"meetingDate":["2024-11-29"],"gazette_id":"11310201","agenda_lcidc_ids":["11310201_00002","11310201_00003","11310201_00004"],"meet_name":"立法院第11屆第2會期第11次會議紀錄","content":"貨物稅條例修正第十二條條文─
