謝謝沈博洋委員"}]}}},"gazette":{"lineno":226,"blocks":[["沈委員伯洋：（12時56分）關於第七十九條的規定，是指在核對的過程當中，然後配合前面修法這一個身分證影本的地方來做核對，但其實這一條正彰顯了這一次修法的荒謬之處。為什麼會這個樣子？因為在修法理由已經很多人都有提過，想要避免死人連署啊、幽靈連署等等之類的，但目前來講，這一些連署之所以會被抓到，其實跟他有沒有附身分證影本，是一點關係都沒有的。也就是說在原本舊法，根本就還沒有修法之前的情形，這些事情是抓得到的，也不會因為你附了身分證影本，就變成抓得到或抓不到。所以在法律上一個很重要的事情是，如果你今天立了一個法的目的是A，你的手段是B，結果B根本就不能達到A，那這樣的修法，其實沒有任何的意義啊！","除了這個修法沒有辦法達到目的之外，還有另外一個更嚴重的問題，當你附了所謂身分證影本的時候，會讓人不太想要連署，這一個是在研究裡面就有指出，這跟一般的選舉不一樣，一般的選舉是兩邊或三邊的對決，所以在對決的過程當中，他可能會去思考我現在站在哪一邊，另外一個站在哪一邊，他比較有底氣。但是在罷免的時候，因為狀況只有一個，就是你在針對現在的當權者、現在選上的那一位做罷免，所以這個時候你所擔心的一定是如果我這樣被知道了怎麼辦？","因為臺灣人民很習慣使用身分證，所以就變成說你的立法完全沒有達到你宣稱的目的，然後還多了一個副作用，那這樣不就完全是一個錯誤的修法嗎？如此明顯的錯誤，其實在協商的時候，我全部都已經講過一次了，但我還記得我在協商的時候，我才講第一句話而已，結果其他的人就站起來走掉了，這樣就變得沒有任何的意義嘛！我們今天要討論，就像很多國民黨的委員一直在講換證日期等等之類的，那可以討論啊！我們今天討論不就是為了要讓你的修法能夠達到你宣稱的目的，又不要造成社會其他的動盪，讓它變成一個比較合適在臺灣能夠被施行的一個選罷法？所以對我來講，除了政治操作之外，為了能夠讓特定的人不要被罷免之外，我實在想不到為什麼要這樣做。即使要這樣做，也沒有問題啊，大家好好討論嘛！最後表決藍白會贏嘛！這個時候全部好好討論讓大家知道意見，然後你們表決贏了，這樣不就好了嗎？為什麼一定都要搞成這個樣子？所以我對於這件事情當然是非常不能夠接受，這是我對第七十九條的意見，謝謝。"],["主席：謝謝沈伯洋委員的發言。","報告院會，現有國民黨黨團提議停止討論。"]],"agenda":{"page_end":1,"meet_id":"院會-11-2-14","speakers":["韓國瑜","江啟臣"],"page_start":1,"meetingDate":["2024-12-20"],"gazette_id":"1140501","agenda_lcidc_ids":["1140501_00002"],"meet_name":"立法院第11屆第2會期第14次會議紀錄","content":"報告事項","agenda_id":"1140501_00001"}}}
